@ Os,
I agree mostly on the character thing. That said, I don't think it was wise to keep adding so many of those types of guys after most of the strong leadership left the Pats lockerroom after 08.

"Pats will take at least a $7.5 million cap charge for Hernandez in 2014

Posted by Mike Florio on June 26, 2013, 10:54 AM EDT

AP
One of the obvious questions that arise in the aftermath of the Patriots’ decision to cut tight end Aaron Hernandez is the cap consequences, if any, for the move.

While it’s trivial in comparison to the fact that this all stems from the death of Odin Lloyd, it’s relevant information moving forward for the Patriots.

For 2013, the Patriots will carry a $2.5 million charge for the portion of his $12.5 million signing bonus, paid last year. Hernandez’s base salary of $1.323 million is fully guaranteed, and so the cap number will remain $4.073 million unless and until the Patriots can finagle a way to avoid paying him. (Chances are they’ll try.)

Because the move comes after June 1, the balance of the cap charge will apply to 2014. That’s $7.5 million in signing bonus money, and possibly another $1.137 million in guaranteed salary. That’s $8.637 million that the Patriots will carry for Hernandez next year.

The Patriots can, in theory, reduce that money by blocking the guaranteed payment(s) or recovering signing bonus money. As to the bonus money, however, the Patriots have to recover it before they get the cap credit. Also, the decision to release Hernandez could prevent them from getting a penny back in signing bonus money.

The broader question, which we’ll address separately, is that the Patriots made this move without caring about the financial or cap consequences.

Thanks, this is what I was asking about.

I think once they cut him, it no longer applies. Had they not cut him, and he couldn't report due to being in jail, then they could have gotten the money back.

Now if the commissioner has some new super secret powers (in the fine print of the CBA), he may have put Hernandez on double secret probation, or something like that.

Since this has dragged on for a week, I would think that someone from the Pats contracts/legal team called someone from the Leagues contracts/legal team to discuss options. I would think it is in the leagues best interest to help teams out of situations like this or else the next time it happens, and it will, the team involves hangs on the the player and diminishes the reputation of the league.

He was released prior to convicted so it's a gray area unless Goodell feels Ahern was hurting the reputation of the NFL/Pats. It's up to Goodell now it seems.

Goodell does have such powers.

Goodell can nullify the contract and the cap hit.

Seems to be a lot of gray area about whether Pats can get signing bonus back and cap relief. From NFL Constitution:
"Whenever the Commissioner, after notice and hearing, decides that an owner, shareholder, partner or holder of an interest in a member club, or any player, coach, officer, director, or employee thereof, or an officer, employee or official of the League has either violated the Constitution and Bylaws of the League or has been or is guilty of conduct detrimental to the welfare of the League or professional football, then the Commissioner shall have complete authority to:

B) Cancel any contract or agreement of such person with the League or with any member thereof;

I'm thinking the Pats organization had inside information from the prosecutor's office.

I agree. The team does good by the league by putting itself at a disadvantage. Pyrrhic victory.

The "Patriot Way" is a myth. You guys win because you have good coaches and good players and are a well run organization. That's no different than any other team who has had sustained success. Or any business for that matter.

That's not a bad thing. It's something to be proud of. But it's built up like Belichick found some ancient texts with a secret only he knows which is both irritating and nonsense (unless you're a patriots fan of course.) Anytime you have something that is over the top and that's constantly rubbed in a lot of people's faces, you're going to have a backlash.

That's all this is. No more, no less.

EDIT: by the way. I'm not blaming you all or even the Patriots for any of that.

I'd say that's not so grey really. Might depends on the charges though.

First off, I will gladly concede that "The Patriot Way" was overblown, but even in releasing Aaron Hernandez they have demonstrated some truth to it exists. We have ample evidence to suggest that many, if not most, of the other teams wouldn't have acted so quickly and/or would have held on for cap reasons.

The latter is what drives me crazy, though. NE has always taken risks. Dillon and Moss are the two more prominent success stories, but guys like Cedric Cobbs, PK Sam and Bethel Johnson weren't exactly choir boys. Yes, they gave Haynesworth a try. but they dumped his ass immediately upon deciding wasn't going to work.

Beyond that, after losing control of the 2009 team, NE had already started rebuilding the locker room. McCourty and McKenzie's character were instsrumental in both arriving sooner than people expected. Go up and down the 2011 draft class and all you see are "I'd let him watch my kids" and "I hope my daughter finds someone like him" type comments. Wilson and Jones in 2012 were high character guys and character was a big part of why the team liked Harmon so much.

Stop, people. Just stop. "The Patriot Way" isn't nearly as overblown as the amount of risks people are claiming NE makes. The character guys are here, they just don't have the experience and cache that the leaders had in 2003.

[/rant]
I agree, Os.

And even if Ahern was off some teams' boards for bad behavior, I doubt it was because his dossier said he would be arrested for something bad in 2013. Reverse engineering doesn't work here for me either. Releasing him does work bc it is the right thing to do.
