Amazing that the officers stopped him, gave him a Breathalyzer, drove to the station, booked him, and released him within an hour. Must have taken 5 minutes the second time since they had all his info already

I was thinking the same thing. Different states have different laws for drunk driving but I thought it was illegal to release someone unless they were under the legal limit.

The second arrest is pretty

Obviously the guy wasn't of sound mind and in no condition to judge his ability to drive home. Either he should have been held overnight or his car/keys should have been impounded.

It makes for a funny news story, but the cops deserve a large share of blame for the second incident.

I know for a fact that you can't be released from a hospital until your blood alcohol level is below the legal limit. I would think it'd be the same for when you're detained by the police.

'After Gammons’s blood alcohol content was measured at .116, he was arrested for drunk driving. After being transported to the Urbana police headquarters, Gammons was issued citations and “released to an adult".'


That Gammons was cited for DUI again an hour after the first arrest is the fault of the person to whom he was released.
