As such, she was a living reproach to those unprincipled, pragmatic "progressives" who wish to demolish American values and institutions in their obsessive pursuit of power over others. I think she may be one of the last of those old-school liberals. Much as I disagreed with her on just about everything, she was nonetheless a creature of the Enlightenment, dedicated to reason, a civilized society, and the supreme value of individuals and their rights, as she understood them.

It would be an insult to her life and memory if the coming battle over a new Supreme Court nominee should descend to the kind of uncivilized spectacle that we witnessed in the Brett Kavanaugh confirmation hearings -- which appalled her. Sadly, given what we've already endured this year, the fights ahead are likely to become even uglier than that, with tribal warfare spilling out into the streets, especially if the election results are contested legally. Had she lived, Ruth Bader Ginsberg would have strived for a peaceful, constitutional, orderly resolution of that contest. I can only hope, though without much confidence, that the dignified, principled model of her life will remain uppermost in the minds of the combatants in the days ahead, so that the country she loved and served so well will survive and heal

Obama was a lame duck, he was out of office in less then two months. Trump, he could be out of office or in office for four more years. The WH was democrat and Senate was Republican back then. Now it is both Republican (as much as you can call Trump a Republican at times). Those are the differences to me.

No. The argument then was split parties as mentioned. The agreement handed down was if different parties Senate/President wait, same party proceed.

Trumps candidate will get advanced for Senate vote.

As NC stated, no chance in hell Dems would sit on hands if in the same situation.

Who cares about a hypothetical? This is the reality we have, and in this one, Republicans stalled nearly a year. We didn't even have party nominees yet.

IRepublicans opened this can of worms. They can try to reinvent the rule all they want. But they're total hypocrites. If the roles were reversed and the 2016 Senate had an Obama nominee potentially to confirm after the election in which the incumbents lost, the Republicans would have had more of an argument.

Even more so, Trump could lose and Republicans could lose the Senate.

That's very much the scenario we could see. It's really hard to see a nominee coming up for a vote before the election. If Trump loses the election, there is no case to confirm.

If Trump loses, and Dems win the Senate, and they ram a nominee through anyway, all hell will break loose.

Back with Scalia, his death was a surprise. No one seen it coming. Obama was a lame duck. He had no chance of being in office in a few months.

This time, if you didn’t see Ginsburg death coming you were blind as all can be. In and out of a hospital for a variety of issues in your late 80’s you never know the outcome. It is very feasible to say any sitting president would have a short list ready to go. Even the media has been predicting trump replacing her due to her health.


Plus let us not forget how the democrats in the house forced through and impeachment with haste. I watched many days of that impeachment inquiry due to work and it was done (at times) without letting republicans do things they wanted to do.

Bottom line: her death was almost predictable and replacing her should be done in a timely fashion since trump is not necessarily a lame duck.
